We may now or in the future allow users to transmit and/or submit contributions to our Services (user Contributions), which may include without limitation any text, photos, graphics, video, or audio material.
You are required to abide by the guidelines for content set forth in these terms whenever you use a feature that lets you submit user Contributions or connect with other users of our Services. You warrant that any user Contribution you provide conforms to these conditions, and you agree to fully repay us for any expenses we incur as a result of your failure to do so.
You may continue to use the user contribution in any way and in any medium as long as it doesn’t conflict with or limit the rights you have granted to us. The license you have granted to us is not exclusive, so you are free to continue doing so.
You hereby authorize us to grant, and we hereby do grant, a non-exclusive license to each user of our Services for such user’s viewing, hearing, reading, streaming, downloading, linking to, and other access to your user contributions to our Services through our Services, as well as for such user’s use of such user contributions in any other manner permitted by the functionality of our Services and in accordance with these Terms.
Your User Contributions and any repercussions that result from submitting them to our services are totally your responsibility. You affirm that:
(a) The user contribution is your original creative work, and you own all rights to it. Alternatively, you have secured all necessary licenses, rights, consents, and permissions to use and authorize us to use all intellectual property rights (including without limitation copyright) in the user contribution to enable us to use it in accordance with these Terms.
(b) Nothing in the user contribution constitutes election advertising, political campaigning, inciting racial, cultural, or religious hatred, defamation, obscene, indecent, pornographic, sexually explicit, harassing, threatening, or offensive, is a false statement that could potentially offend someone’s religious or racial feelings, is in contempt of court, or publishes personal information with the intent to harass.
(c) Unless you have the express, prior permission of the other person (or their parent or guardian if they are under 18), firm, or enterprise in connection with your user Contribution or in connection with your use of our Services, you will not collect, obtain, compile, gather, transmit, reproduce, delete, revise, view, or display any material, data, or information, whether personally identifiable or not, posted by or concerning any other person, firm, or enterprise.
(d) The user contribution is free of any malicious code, such as a virus, corrupt file, cancelbot, worm program, or malicious code intended to limit the functionality of any software, hardware, telecommunications, networks, servers, or other equipment, as well as any adware, spyware, Trojan horse, or other material aimed at inflicting harm to, interfering with, incorrectly intercepting, or extorting any data or personal information;
(e) For whatever purpose, you may not alter any TCP/IP packet headers or portions of the header information in any user contribution;
(f) You must refrain from submitting any content or doing any activities that lead to the distribution of junk email, chain letters, surveys, competitions, multi-level marketing (MLM) and pyramid selling (PSM) schemes, duplicate or unsolicited messages, or so-called “spamming” and “phishing”;
(g) As a result of our use or exploitation of any user Contribution, we shall not be obligated to pay or incur any sums to any person or organisation.
17. In exchange for our being granted the non-exclusive, royalty-free right to use any name, likeness, image, voice, position, or likeness in connection with any user contribution, you expressly renounce any moral rights or comparable rights (such as the right against false authorship attribution) currently in existence or created in the future anywhere in the world.
You have provided us with your user name, screen name, likeness, photograph, signature, and/or biographical information.
You must perform all additional actions, execute and deliver any additional papers, and ensure that any required third parties do so in order to confirm the licenses and rights granted under these Terms.
All user contributions will be regarded as non-confidential, and we shall be free to use, reproduce, disseminate, and reveal any such content to other parties for whatever objective. We also reserve the right to contact any third party who has a claim that any content submitted or uploaded by you to our site violates their intellectual property rights, their right to privacy, or any other law or regulation that may be in force.

If we have notified you more than twice that you are engaging in an infringement activity, we shall terminate or suspend your access to the Service and/or (if applicable) your Discovery Account.
You must halt all actions permitted by these Terms of Use, including your use of the Service or your Discovery Account, if we cancel or suspend your access to the Service or (if applicable) your Discovery Account.

Our Obligation To You

We acknowledge our responsibility for any wrongful death or physical harm brought on by our own fault or that of our employees or agents. We do not aim to limit our responsibility for willful wrongdoing, gross negligence, or fraudulent misrepresentation on our part or those of our employees or agents.
In the event that we violate these Terms of Use, we are solely responsible for losses that are a reasonably foreseeable result of that violation. Losses are predictable if you and we could have anticipated them when you agreed to these Terms of Use.
To the extent allowed by applicable laws governing consumer protection and/or as far as it is practical to do so, we disclaim any liability for:
(a) Any indirect or resulting losses you could experience. This covers (i) any loss of profit (direct or indirect), (ii) any loss of goodwill or business reputation, (iii) any loss of opportunity, (iv) any loss of data experienced by you, and (iv) any loss of opportunity.
(b) any unauthorized use of the Service or Content;
(c) any issue with, or interruption of, the Service or Content brought on by unavoidable events that prevent us from keeping our promises to you;
(d) mistakes, malware, or other issues brought on by your use of the Service or Content;
(e) the Service or Content not operating properly with other hardware or software, including any of your devices;
(f) any Content and other communications data that are kept or communicated by or through your use of the Service being deleted, damaged, or not stored;
(g) any action or omission that is out of our reasonable control and committed by a third-party platform, service provider, supplier, device manufacturer, or provider of a device operating system.
According to the applicable legislation in your jurisdiction, you have a number of statutory rights. These statutory rights are not intended to be affected by anything in these Terms of Use. Please get in touch with your neighborhood consumer organization for further details regarding your legal rights. 15.5 To the largest extent possible by local law, we will not be liable to you for any damages related to your use of the Service or the Content, save for liability deriving from the events described in section 15.1 (which is uncapped).
Although we will make every effort to resolve any technical issues that come to our attention, we cannot guarantee that the Service or the Content will be bug- or error-free or that your access won’t be interrupted (for example, there may be downtime for maintenance or updates or any power or server outages or other reasons outside of our control).

The agreement between us and you is personal to you, and no third party has any right to benefit under it, unless otherwise specified below. You acknowledge and agree that we may assign, subcontract, and sublicense (as appropriate) our rights and duties under these Terms of Use to any corporation, partnership, or individual provided that such assignment will not have a negative impact on your Discovery Account. Your rights or duties under these Terms of Use may not be assigned to another party.
You acknowledge and agree that each company in the Discovery group of companies shall be a third-party beneficiary to the Terms of Use and that such other companies shall be entitled to directly enforce and rely upon any provision of the Terms of Use which confers a benefit on (or rights in favour of) them.
